Does any one have any advice about AC21
Is it advisable to file AC21 soon after changing/ joining new employer?
OR
Just keep quite and look for any RFE, if any RFE comes up send AC21 form and updated employer information along with it.
IS there any guidelines from people who already did it successfully

CAN WE APPLY 140 and 485 without physical Labor APPROVAL?
My lawyer emailed me saying that she called P-BEC and my LC is approved. We neither have the physical paper nor the online status shows "In-Process"

The Congressional Hispanic Caucus has sent a letter to the President asking him to terminate the controversial 287(g) program that allows local police to enforce immigration laws on behalf of the Department of Homeland Security. The CHC expressed its concerns about allegations of serious civil rights violations against Hispanics as well as recent reports of poor oversight in the program. Until we ask they don't give anything, I have been writing to Ombudsman, for this and have raised it on an Ombudsman call, but USCIS is just too much...

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. I had my I-485 interview at Boston-CIS in May,2007 and since then they were telling me lots of BS like NC, One security check open, additional review. Finally they sent me a letter telling me I need to attend NSEER interview at ICE office in Boston and I did that this week and the nice ICE officer told me that he was sending my file back to NSC. Last time I saw that thick file was when I was interviewed by IO at Boston-CIS!. Does it mean NSC will approve it now? I'm EB2 ROW and I was never finger printed more than once. So far had 2 EAD/AP and I applied in 2006 August

I'd like to know can a dependent (not the prime applicant) on a pending 485 status, avail unemployment insurance, especially the extended benefits which are being given by Federal govt. to the states.
This is the latest from USCIS :

it says, that unemployment compensation is not public charge.
Does it even apply to both standard unemployment insurance and the extended benefits.

Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?
Yes, it is possible to obtain a Green card from L1B. However, you will have to undergo the Labor certification process (PERM application). Time wise there will not be a difference whether you apply under H1-B or L1B. It is only foreign nationals who are managers and executives on L1A status are eligible to apply for the green card without the labor certification.

Hi,
My wife is on H1B and she couldnt work for the past 6 months. I applied for my I 140 and I 485 during the July fiasco last year and she was not added as my spouse and we got married at a later date.
Since she didnt receive pay for 6 months, I guess she is out of status for these 6 months. So my question is will this have any effect on her GC process when I add her as my spouse to the I 485 application whenever my priority date become current ? I am really worried and dont want to screw up my GC process after a long wait.

It would be very tough to get CP appointment before the end of July. So I am not even thinking of CP. Also CP needs to be approved when your PD is current.

one does not have to advertise for H1, might be they are advertisement is for filing your Labor application for GC.
