Hmm...so the Name Check hell is back.
Good news for EB2 I/C and all EB3 old filers ! These will save huge number of visas for them. Not many People who have filed in July 07 Visa bulletin fiasco would have FBI name check pending.

Hi guys,
My LCA got denied today (reason unknown) and my H1-B has expired on Nov. 1 as well. :(
I also have a pending I-485 petition with approved I-140. I also have a valid EAD. So I assume, I am currently shifted to AOS pending status working on EAD.
My question is whether this denial negatively affects my pending I-485 application? I assume not but just wanted to confirm anyways :confused:

Gurus Need Help.
We filed for I-485 on july 3rd..and got receipt numbers after calling USCIS for 3 of us.Yesterday we got receipt notices for me and my wife..but for my son we haven't received the notice when i checked the status online..it says case is rejected and here is the text message from the online..,
"On October 10, 2007, we determined that this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was not properly filed, rejected it, and mailed it back to you with all supporting materials along with a notice describing the reasons the case was rejected. The notice will also describe what will need to be done to properly submit the case"
Is any one with the similar situation? Please help what could be the reason??
and how long it will take to receive the rejected notice?

Need some help/advice on PERM LC issue:
My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters or Bachelors with 5 Yrs experience),
On may'09 got a query saying "Discrepency in Alien education and experience".
Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.
my emplyer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"
my question: 1) Can this be considered as an error from the procesing center rather than my empr fault.
2) How severe this would be and what ud be the turn-over-time.
3) Do I need to reapply my PERM LC again.

We have since decided to hire a lawyer and have met with two attorneys so far. The process is frustrating because of the requirement to pay a consultation fee; we schedule an appointment, meet, and find out that the cost of hiring the lawyer is far greater than what we can afford.
My question is: does anyone know of a good lawyer who charges a reasonable flat fee? $1000 - $1500?

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.

I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.

USCIS had been given strict guidelines to process all cases within a six month timeframe depending on the type of the case. But many cases have come to light which are not seeing the light of the day.
How about filing our taxes on April 16, but not on April 15.
Exactly what is your logic? There is no law against their getting delayed in completing a case in 6 months. There is a law for not submitting taxes on time. That is why I think this argument is not very valid. I can see your frustration with the delays at USCIS, however, and sympathize with it.

I know that we can file I-140 under premium for the non-substitute labor, and I am not sure if we can file under premium using the substitue labor.

I'm talking with couple of companies about getting a H1. What documents I need to show for H1 for USCIS? Do I need to show any experience to USCIS?

You need to have a job offer, a LCA for the job, educational evaluation, I-129 and copies of your passport/i94 and degree. A supporting letter from the employer is also needed. No experience letter is needed to apply for H1, but to get it stamped you may need it.

I must admit I'm not very photoshop savy. I'm looking for some advise on this picture. I took it with a polarizer and have spent many hours trying to photo edit it to make it lighter without losing the color of the sky but can't seem to get it quite right. Any suggestions? Thanks in advance.

Option 1 (epassporphoto) is good. I have used it more then once for US as well as UK visa (also my daughter's Indian Passport)
Just a few tips --
Make sure
1) you take the photo under Fluoroscent (tube) light or outdoor.
2) there is not too much shadow behind
3) the background is white (or something very light)
4) if you wear glasses, remove those
5) your face should be straight (both ears should be visible)
