Right - You will have to wait to apply for 485. You can do so only once your Priority DAte is current on the VISA Bulletin.
You can file for i-140 though.......I guess you have a long wait to file 485 and EAD/AP

When you reach NSC or TSC, you talk to an IO. Who really is an IO? Are they first line of customer service at the centers? They then send requests etc to officers handling your cases?

Hi,
I got an RFE on EAD Renewal and notice says the following.
The application you submitted must bear the original signature of the applicant. You must sign the attached copy of Form I-765 in the signature block marked in Red.
I got only RFE notice with this information and there is no attachment with this RFE.
I am 200% sure that I signed the application.
Now I have no idea what to do and there is no attachment to sign.
I filed myself without attorney help.
Any one please help me how to handle this RFE.
Can I send new I-765 application or request again for attachment
My EAD expiring on 8/26/2008

1. What happens to old passport. I took Appt with old passport number?
2. Can I keep my old passport?
3. Is it OK to go for new renewed passport? Or will it impact the H1B stamping and interview process?

It will be suicidal to assume that CIR is somehow bad for us, and incriminate any effort for CIR. My point earlier was not that CIR is bad for EB, but about the actual reason for Sen. In a particularly liberal construction of the law, Mr. Yates indicates that, if a labor certification, previously approved for another "green card" candidate but unused for that candidate, is now being used to support an I-140 petition for an H1B status holder, the date of filing of the original labor certification may be used for that H1B nonimmigrant to file for one-year incremental H1B extensions, as long as additional proof is submitted that the person has a pending or approved I-140 based on that labor certification. Under this interpretation, therefore, a person who is using a substituted labor certification that was filed more than 365 days prior, but whose employer filed the I-140 petition for the H1B employee only two months before the six-year H1B window expired, is now eligible for the one-year incremental extensions.
Can I get 7th year extension with help of I140 receipt?
Is any one applied for H1B 7th year extension using 21st Century DOJ Appropriations Act, if yes what type of documentation we need to submit while applying for extension?

My I-485 application was rejected because of attached I-130. The rejection reasons was not clear enough and I re-submitted package without removing I-130. Today, I sent USICS a letter requesting to withdraw I-130 application. Don't really know what would happen now...

If you are eligible for EB1, file I-140 now. EB1 is always current in every VB. No need to port EB3 PD. For EB1, no need for Labor process; direct I-140 filing.

My job qualifies for EB1 now and few of my peers have got Green Card under EB1. Can I port my filing from EB3 to EB1? Would it be better to do it with current employer or with a new employer? Pl. advice.
