This is one of the most hilarious thing I heard in months, thought I'll share....

It was the first day of a school in USA and a new Indian student named Chandrasekhar Subramanian entered the fourth grade.
The teacher said,
"Let's begin by reviewing some American History. Who said 'Give me Liberty or give me Death'?"
She saw a sea of blank faces, except for Chandrasekhar, who had his hand up: 'Patrick Henry, 1775' he said.
'Very good!'
Who said 'Government of the People, by the People, for the People, shall not perish from the Earth?'
Again, no response except from Chandrasekhar. 'Abraham Lincoln, 1863' said Chandrasekhar.
The teacher snapped at the class, 'Class, you should be ashamed. Chandrasekhar, who is new to our country, knows more
about its history than you do.'
She heard a loud whisper: 'Fuck the Indians,'
'Who said that?' she demanded. Chandrasekhar put his hand up. 'General Custer, 1862.'
At that point, a student in the back said, 'I'm gonna puke.'
The teacher glares around and asks 'All right! Now, who said that?'
Again, Chandrasekhar says, 'George Bush to the Japanese Prime Minister, 1991.'
Now furious, another student yells, 'Oh yeah? Suck this!' Chandrasekhar jumps out of his chair waving his hand
and shouts to the teacher , 'Bill Clinton, to Monica Lewinsky, 1997!'
Now with almost mob hysteria someone said 'You little shit. If you say anything else, I'll kill you.'
Chandrasekhar frantically yells at the top of his voice, Michael 'Jackson to the child witnesses testifying against him- 2004.'
The teacher fainted..
And as the class gathered around the teacher on the floor, someone said, 'Oh shit, we're screwed!'
And Chandrasekhar whispered quietly, "the Republicans, November 4th, 2008".

I don't understand in what cases consulate holds a person's passport. What if the applicant wants to return back home country instead of waiting in Canada?

That's just like any other transactions. There is no sales tax for real este transactions. There maybe long or short term gains depending on how the house was acquired. Once you are filing as a permanent resident for tax reasons, EAD, AP, H1 etc, do not matter. Bottom line you pay taxes on income (whether short term or long term gain and other rule) and it has no bearing on the details of your legal status.

I've asked my lawyers and they are unwilling to say either way because they think USCIS could rule on it some day.
Leadership. They've heard of it.

You're a bit confused. To get investor's visa, you need to invest either in certain underdeveloped areas (half a million will be sufficient), or you need to create a certain number of jobs with your investment/business. I wonder, however, if one would qualify by buying an expensive house and providing jobs for 10+ people maintaining your house on a full-time basis. :)

I asked same question to my lawyer 2 days ago & he said "YES". One can request to consider for multiple categories by reapplying I140 again. Lates USCIS's Q&A confirms that...

A. If you want to classify the alien beneficiary under multiple visa preference categories, file a separate Form I-140 petition, with the required fee and supporting documentation for each requested visa category.
As far as your labor qualifies for EB2, you are OK.

485 - If u are from India or China and based on current situation for Eb2 it could take upto 4 years and 6-7 years for EB3. If you are from Rest of the world it would be 1-2 years.
However, if the SKIL bill passes, things could change and you could get the whole GC within 2 years or so.........Keep hopeful...that is what I am doing after 8 years on H1........with a MBA from a US University!!

it is very important that you seriously consider the options you have at the earliest.
You should try to talk to an immigration attorney at the earliest.
Reading your case, I think best would be for you to find another job and file a new PERM application. You will retain the earlier priority date.
Additionally, have you considered getting a 3 year H1B extension based on the approved 140? I am not sure whether you can do it because you no longer work for this company. So, when you got a H1B transfer (for the new company B), did they give you 3 years or 1year extension for H1B?

That does sound more reasonable given it's a digicam.
