If your employer fully support you on your entry into USA after long stay in India, you are good.
You may need to show documents, letter from employer, and also he will be ready to answer phone upon entry. (they may ask him whether a job is available for you).
You can enter before your visa expiry.

Stick with your wifes country dates. The dates in India wont be stable for long.

Your H1B is tied to your current company. If your new employer wants to hire you, they have to file a separate H1B for you.
So your answer should be. "I need H1B sponsorship to work."

Hi,
I was working on L1 before and my h1 was approved in october but i joined on h1 only in december before the 60 day grace period?
Now i need to visit to india so
1) Will there be any problem to get stamped in india if i travel in April ?
2) Can i get stamped in Mexico or Canada? How many pay slips n other documents do i need ? What is the process of getting stamped in Mexico or Canada?
3) Which one is less risky (going to mexico or canada) ?
Please let me know ASAP. I appreciate your help on this.

I have a request / concern / what ever you would say.
Please do not cirtize if you do not like the idea, just ignore and leave the thread.
There are so many people comming to IV for other experts guidance on different things mainly on H1B status, AC21 status, AP, FP, EAD and H4 to EAD, .....
Why don't you create a general guide lines or rules or do's and don't or QA's for each topic, so that each member or visitor who come to IV can atleast go through them before asking or posting quesitons.
You can create a survery for different kinds of questions people / members / visitors might ask or have fore each topic before creating the thread so that we can have a pool of questions and answers for each topic from experts or attorney answered. (you might say we have recordings from attorney Prashanti Reddy, but it would be good if we have some thing which can be referred easily i.e., typed.
These are just some of my thoughts, it can or cannot be implemented. It depeneds on IV admins/Gurus/Experts on this forum.
Gurus, please provide your thoughts.

i am switching employers and i have about 10k in my 401k with current employer. my next employer does not have the option to start 401k until after one year of service.i am looking for options to rollover my 401k to a IRA in a company. does anyone have any recommendations?thanks in advance
I still have my 401K from my old job that I quit about 3 yrs back into the same (company's) account. The reason I didn't roll them into IRA is that I prob would have made the same selection of mutual funds that I currently have in my 401K. The company is stable so no worries there. Point is, move your money only if you think it will serve you a better purpose or else wait for your new 401K to kick in and after that just roll over the other account directly into the new one...
Just my 2 cents, of course...

I am currently in the U.S on H1b for the past 4 years. My H1b is for a computer programmer. I work my day job in that capacity. My Labor certification in under process. I have also been auditioning as an actor for Commercials and Industrial Films. It looks like I may be cast in an industrial film. My question is : If I accept the part, will this violate the terms of my H1-b ? Also, if I am approved for an EAD down the road, can I use the EAD to do acting work on the side ? Thank you for your time.

Hi all,
I am currently out of USA.My new employer has submitted H1 Transfer and extension of stay.
The petition has been approved along with new I-94. I have the original I-797 with me .
I understand that we have to surrender I-94 before leaving USA.But in my case I got I-94 after I left USA.Now I need to go for visa stamping in India.
Should I submit the new I-94 to the US consulate in India?
Please advise.

I don't intend to get anyone's hopes high as I am not sure if this page on the USCIS website is an updated one or is an older one, but it says PP is available for 129 & 140.

That helps somehow I was under impression that once you invoke AC21 you have to use EAD. I prefer to be on H1 as long as possible till GC come.

yes. AC21 is a provision to allow you to change employers without affecting ur 485. It has nothing to do with work authorization. Your authorization can come from ead or h1 transfer.

Good evening,
I am currently in the United States and in the process of changing my Q1 into a F1 visa.
My contract with the Q1 visa unexpedently ended in June 2009 and the visa was expiring on the 17th of september 2009.
I sent the file with all the papers to the USCIS before the end of the expiration date and is still in process at this time.
I heard that i can not exceed the period of 180 days after my last day of work with my Q1 Visa.. Is this true ?
I was thinking by the time i filed everything before the end of my Q1 visa, i could stay in the United States until the approval or denial of my F1 visa...
if this is true :
1. Do I have to wait in France for the answer of the USCIS, or my case will be cancelled and I have to start all oveer again in France ?
2. If I do not stay more than 180 days, going back to France and coming back for exemple 1 week after to the US with a tourist visa, am I able to change my status to F-1 ?
3. If i receive an approval answer from USCIS after a few days that I've been back in France, will it be valid ? Can it be sent to me ?
4. Do I have to get a new I-20 from the university if I am starting the process in France, or the one that I have is still valid ?
Could you help me please, beause i am confused...:confused:

When someone says it is ok, it sure is a relief but just for clarification, what is the asnwer to be given by someone is the same situation at the POE when asked whether he is working for the GC filing company or not
